These Terms of Service ("Terms") apply to the services and website of Toruus Insurance Agency dba The Full Service Team ("Agency," "we," "us" or "our"). They take effect on [Effective Date].
By requesting a quote, submitting an application, buying or servicing a policy through us, or using our website, you agree to these Terms. If you do not agree, please do not use our services.
We are an insurance agency licensed in [states where licensed, for example New York, Connecticut and New Jersey]. We are not an insurance company. We do not underwrite or issue insurance policies, and we do not pay claims.
We help clients shop for and obtain insurance, including:
We obtain quotes only from insurance carriers with which we hold an appointment ("Carriers"). We do not represent every insurer in the market. We do not promise that any quote is the lowest price or the broadest coverage available.
Every policy is issued by the Carrier, not by the Agency. The policy is a contract between you and the Carrier. Your policy documents alone define your coverage, limits, deductibles, exclusions and conditions. If anything we say, write or post differs from your policy, the policy controls.
A quote is an estimate, not a policy. It is based on the information you give us and the Carrier's rates and rules at the time. A quote is not a contract, an offer of coverage or a guarantee of premium, and it may change or expire.
The Carrier sets the final premium after its underwriting review. That review may include driving records, claims history, property inspections and, where the law allows, credit-based insurance scores.
Coverage is not in effect until the Carrier, or a licensed agent of ours with authority to bind, confirms to you that coverage is bound and any required payment has been made.
Coverage cannot be bound, changed or cancelled by voicemail, email, text message, website form or social media message. A request sent this way is not effective until a licensed agent confirms it to you.
Do not cancel existing coverage until we or the Carrier confirm that your new policy is in force.
The Carrier makes all underwriting decisions. We do not control those decisions and are not responsible for them.
At any time, including after a policy has been issued, the Carrier may, as the policy and applicable law allow:
If you do not give the Carrier what it asks for by its deadline, the Carrier may raise your premium, cancel your policy or decline to renew it.
The Carrier is responsible for sending any notices the law requires. We can help you understand a notice and look for other options. We cannot overturn a Carrier's decision, and we do not guarantee that replacement coverage will be available.
We do not guarantee that any Carrier will offer, issue, renew or continue a policy. We also do not guarantee the financial strength or solvency of any Carrier.
You (as our client) agree to:
Inaccurate or incomplete information may lead the Carrier to change your premium, deny a claim, or cancel or rescind your policy.
Premiums are owed to the Carrier. If a premium is not paid on time, the Carrier may cancel the policy, and we are not responsible for any resulting lapse in coverage.
We do not process, adjust, investigate, approve, deny or pay claims, and we are not responsible for doing so. The Carrier that issued your policy handles every claim and makes every claim decision under the terms of the policy.
We are not responsible for a Carrier's coverage determinations, claim denials, delays, or the amount of any settlement or payment.
Life insurance applications are subject to the Carrier's underwriting, which may include health questions, a medical exam and a review of medical records. The Carrier decides whether to offer coverage and at what rate.
Life coverage is not in effect until the Carrier approves the application, the policy is delivered and the first premium is paid, unless a conditional receipt or temporary insurance agreement issued by the Carrier says otherwise.
Any illustration of non-guaranteed values is an example only, not a promise of future performance. Do not cancel or replace an existing life insurance policy until your new policy is in force.
We are licensed insurance professionals. We are not attorneys, accountants, tax advisors or investment advisers. What we share is general insurance information. Please consult your own advisors about legal, tax, estate planning or investment questions.
By giving us your phone number or email address, you agree that we may contact you by phone, email or text message about your quotes, policies, renewals and service requests. Message and data rates may apply. You may opt out of marketing messages at any time.
You agree that we may send you documents and notices electronically, unless you ask us for paper copies.
Voicemail, email and text messages are not monitored at all hours. Standard email and text messages are not secure. Please do not send Social Security numbers, bank details or other sensitive information that way. Use our secure upload at [link] or call us instead.
We collect personal information so we can obtain quotes and service your policies. We share it with Carriers and with service providers that help us do this work.
Carriers may obtain reports about you, such as driving records, claims history and, where the law allows, credit-based insurance scores. Our Privacy Notice at [link] explains how we collect, use and protect your information.
The content on our website is general information only. It is not an offer of insurance and does not describe any policy in full.
You agree not to misuse the website, interfere with its operation, or submit false information through it. The website's content belongs to the Agency or its licensors. Links to Carrier and other third-party websites are provided for convenience, and we do not control those sites.
To the fullest extent the law allows, our services and website are provided "as is." We do not guarantee that coverage will be available, that a quoted premium will be the final premium, that you will save money, or that any claim will be paid.
To the fullest extent the law allows, the Agency and its owners, employees and agents are not liable for:
Our total liability for any claim relating to our services will not exceed [amount, for example the commissions we received on your policies in the prior 12 months].
Nothing in these Terms limits any liability that cannot be limited by law, or any duty we owe you as a licensed insurance producer.
To the extent the law allows, you agree to reimburse the Agency for losses and reasonable costs that result from false or incomplete information you gave us or from your breach of these Terms.
These Terms are governed by the laws of the State of New York. Any dispute about these Terms or our services will be brought in the state or federal courts located in Westchester County, NY.
We may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of our services after that date means you accept the changes.
These Terms cover your relationship with the Agency. They do not change your insurance policy, which is governed by its own terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our choice not to enforce a provision is not a waiver of it.
